Register You Logo As A Trademark – If you’ve just launched your brand and want to protect your logo, one question quickly comes up: When can I legally use the ® symbol? You might have seen other businesses using it proudly next to their logos or brand names. But did you know that using it without registering your trademark is actually illegal?
Let’s clear it all up. Here’s everything you need to know to register your logo as a trademark in the UK – in plain English.
What does ® really mean?
The ® symbol tells the world that your logo or brand is officially registered as a trademark. It shows you’ve taken legal steps to protect it, and others can’t copy or use it without facing serious consequences.
But here’s the catch: you can’t just stick the ® on your logo and hope for the best. You need to follow a proper legal process – and in the UK, that starts with the UK Intellectual Property Office (UK IPO).
Step 1: Check if your logo is eligible
Before you rush into the application, you need to make sure your logo can actually be registered. The UK IPO has rules, and it’s not a rubber-stamp job.
Your logo must be:
- Distinctive – Something unique that clearly identifies your brand. If it’s too generic, it might not qualify.
- Original – It must not be too similar to logos or names already registered.
- Appropriate – It can’t be misleading, offensive, or include banned symbols.
Tip: Use the UK IPO Trademark Search tool to see if anything similar already exists. It’s free and very easy to use.
Step 2: Decide what to register
You’ve got options – it’s not just about the picture.
You can register:
- Your logo (the visual symbol or design)
- Your business name
- Or a combination of the two (which is often the best bet for full protection)
Think about where and how you’ll use your branding. If your name and logo always appear together, registering the combo might make sense.
Step 3: Apply to register your logo as a trademark
Once you’ve checked it all over and made your decision, you can submit your application online at the official UK IPO website:
👉 Apply to register a trademark
You’ll need to:
- Choose your trademark class (this defines the industry you operate in – for example, class 35 covers advertising and marketing)
- Upload your logo or describe the trademark you’re registering
- Pay the application fee
Cost: Starts from £170 for one class
Timeframe: Expect to wait 3–4 months if there are no objections
If your application goes through smoothly, you’ll receive a certificate of registration. From that point on, you’re officially protected.
Step 4: Use the ® symbol –
but only once approved
This is important. You must not use the ® symbol until your logo is officially registered.
Using it early – even if you’ve applied – is against the law in the UK and could result in a fine.
While you wait, you can use the ™ symbol instead. It shows you’re claiming the brand as yours, even if it hasn’t been registered yet. It doesn’t give legal protection, but it sends a message that your brand identity matters.
What happens if someone copies my logo?
Once registered, you’ve got legal backing. If someone uses your logo (or something similar), you can take legal action to stop them and potentially claim damages. Registration gives you exclusive rights – and that’s a powerful business tool.
What if I need help?
